Terms of Service

These Terms of Service ("Terms") govern your use of emailcontrol.net (the "Service"), operated by EmailControl ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company, and "you" refers to the company.

1. What the Service Is

EmailControl is a monitoring and alerting service. We periodically query public DNS blacklists and public DNS authentication records (SPF, DKIM, DMARC) for domains you register with us, compute a health score, and notify you of changes. The Service is advisory only: it does not send email through your domain, does not access your mail server, and does not modify your DNS records. Acting on the information we provide — and verifying it before acting — remains your responsibility.

2. Accounts

You must provide a valid email address and keep your credentials confidential. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk for us or other users.

3. Acceptable Use

You agree to monitor only domains you own, operate, or have authorization to monitor on behalf of a client. You will not use the Service to harass third parties, probe infrastructure you have no relationship with, resell raw monitoring data without our written consent, attempt to circumvent plan limits or rate limits, interfere with the Service's operation, or use automated means to access the Service other than the documented API with a valid API key.

4. Plans, Billing, and Cancellation

The Free plan is provided at no charge with the limits described on the pricing page. Paid plans (Pro, Agency) are billed monthly in advance through Stripe and renew automatically until cancelled. You can upgrade, downgrade, or cancel at any time from your dashboard; cancellations and downgrades take effect at the end of the current billing period, and we do not issue prorated refunds for partial months except where required by law. We may change prices with at least 30 days' notice; continued use after a price change takes effect constitutes acceptance. If a payment fails and remains unpaid after reasonable retries, we may downgrade your account to the Free plan, which reduces domain limits and history retention accordingly.

5. Data and Privacy

Our collection and use of your information is described in the Privacy Policy, which forms part of these Terms. You retain all rights to your data; you grant us only the license needed to operate the Service — storing your domain list, running checks against it, and displaying results back to you.

6. Third-Party Services and Data Sources

Blacklist status is determined by querying third-party DNSBL operators (such as Spamhaus, Barracuda, SORBS, and SpamCop). These operators control their own listing criteria, data accuracy, and availability; we have no control over and no affiliation with them. A "clean" result means the queried zones returned no listing at the time of the check — it is not a guarantee of deliverability, inbox placement, or future status.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. DNS is a distributed system: propagation delays, resolver failures, and blacklist operator outages can cause results to lag reality or be temporarily unavailable. We do not warrant that monitoring will be uninterrupted, that every listing will be detected, or that alerts will always arrive within any particular time.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMAILCONTROL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITIES ARISING FROM UNDELIVERED EMAIL — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR FIFTY US DOLLARS ($50) IF YOU USE ONLY THE FREE PLAN.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate the Service, or your access to it, for violation of these Terms, non-payment, legal requirement, or discontinuation of the product; where practical we will give reasonable notice. Sections 5–8 survive termination.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced by email to account holders or by prominent notice on the site at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
